The arbitrator may not consolidate more than one person's claims, and may not preside over any form of class or representative proceeding.

Notwithstanding the foregoing, either party may seek emergency injunctive relief in a court of competent jurisdiction to prevent irreparable harm pending the completion of arbitration. Claims for intellectual property infringement may be brought in court without first resorting to arbitration.
